1. Scope of Services & Marketplace Disclaimer
Anchor Learning Network operates strictly as a hyper-local community marketplace directory connecting independent educators (“Educators”) with families seeking academic or enrichment support (“Clients” or “Parents”).
- No Employment Relationship: Anchor Learning Network is a listing and matching platform only. Educators listed in our directory are strictly independent professionals operating their own solo businesses. They are not employees, agents, partners, or joint-venturers of Anchor Learning Network.
- Independent Contracts: Any agreement, scheduling, lesson plan, or business transaction formed between an Educator and a Parent is an independent contract solely between those two parties. Anchor Learning Network is not a party to, nor responsible for, the performance, quality, or outcomes of those independent agreements.
- Platform and Matching Assistance Disclaimer: Whether a User discovers an Educator via self-directed search on the public directory or through a personalized match recommendation provided by Anchor Learning Network staff during pilot phases, all final hiring decisions rest solely with the Client. A recommendation, pairing, or manual match assistance does not constitute an endorsement, guarantee, or assumption of liability for the Educator’s services.
2. Platform Fees & Financial Transactions
- Direct Payment Structure: All compensation for educational services is negotiated and paid directly by the Client to the Educator. Anchor Learning Network does not act as a payment escrow, processing agent, or fee collector for independent tutoring sessions, and we do not take a financial commission or “cut” from the earnings generated between Educators and Parents.
- Platform Access Fees: Anchor Learning Network reserves the right to charge flat subscription fees, listing fees, or administrative vetting fees to users (Educators or Clients) to access or maintain placement on the Platform.
- Financial Disclaimers: All financial arrangements, hourly rates, group fees, billing schedules, and cancellation/refund policies must be managed directly between the Educator and the Parent. Anchor Learning Network holds absolutely zero liability or responsibility for unpaid invoices, payment disputes, or processing errors between parties.
3. Educator Vetting & Disclaimer of Warranties
- Verification Limits: Anchor Learning Network requires all listed Educators to undergo a credential review and a criminal background check (via a third-party provider like Checkr or a verified Rhode Island BCI screening) prior to public directory placement.
- No Ongoing Warranty: While we take vetting seriously to support community trust, background screenings are a reflection of public records at the specific time they are pulled. Anchor Learning Network makes no explicit or implicit warranties regarding the ongoing accuracy, safety, behavioral conduct, or teaching efficacy of any individual Educator.
- Parental Due Diligence: Parents acknowledge and agree that the ultimate responsibility for verifying an Educator’s suitability, conducting personal interviews, and ensuring a safe learning environment for their children rests entirely with the Parent.
4. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Anchor Learning Network, its founder, or its affiliates be held liable for any direct, indirect, incidental, consequential, special, or exemplary damages arising out of or in connection with your use of the Platform. This includes, but is not limited to:
- Property damage, personal injury, physical harm, or disputes occurring during in-person or virtual learning sessions.
- Misconduct, theft, or contractual breaches committed by either an Educator or a Parent.
- Academic outcomes, grades, or test performance resulting from educational sessions.
5. Learning Spaces, Safety, & Mandated Reporting
- Independent Spaces: If an Educator conducts lessons at their own private studio, classroom, home, office space, or a public location, the safety, structural integrity, and liability insurance for that space are completely the responsibility of that independent Educator. Anchor Learning Network does not inspect, manage, or insure any physical spaces where independent sessions take place.
- Safety and Reporting Compliance: Independent Educators operating on the Platform are solely responsible for maintaining their own professional liability protections and complying with all applicable state laws, including Rhode Island’s mandatory child abuse and neglect reporting laws (R.I.G.L. § 40-11-3). Anchor Learning Network is not responsible for monitoring, overseeing, or executing the behavioral conduct or statutory reporting obligations of independent directory users.
6. Rhode Island Independent Contractor Compliance
By applying to list services on the Platform, Educators certify that they operate an independent professional business entity. Educators acknowledge that they are solely responsible for filing any required documentation with the Rhode Island Department of Labor and Training (DLT)—including the Notice of Designation as an Independent Contractor (Form DWC-11-IC) if applicable—and maintaining their own appropriate workers’ compensation exemptions or insurance policies.
7. Directory Content & Intellectual Property
- All directory bios, profiles, text, logos, and digital branding elements on the Site are the property of Anchor Learning Network or are used with explicit permission from the applied Educators.
- Users may not scrape, harvest, or utilize contact information from our directory for the purposes of corporate marketing, unsolicited spamming, or building competing educational listings.
8. Governing Law
These Terms, and any disputes arising from your use of the Platform, shall be governed by, construed, and enforced in accordance with the laws of the State of Rhode Island, without regard to its conflict of law principles.
9. Modifications to Terms
We reserve the right to modify or replace these Terms at any time. Any changes will be posted directly on this page with an updated “Last Updated” date. Continued use of the Platform after changes are posted constitutes acceptance of those updated terms.
